Introduction

Cambodia's economy is flourishing with a surge in business expansion of international companies in the region. While labor laws are well laid out, navigating official pronouncements (Prakas) can be an administrative burden for foreign-invested companies.

Additionally, the legal landscape is subject to change, making it challenging to stay updated on employer obligations and workplace compliance.

Thankfully, this guide serves as your compass, providing updated explanations of leave policy in Cambodia, along with the latest solutions for streamlined administration.

Adoption Leave in Cambodia

Cambodia’s labor law currently does not have specific provisions for adoption leave. However, you may consider the following alternatives to grant adoption leave in Cambodia:

  • Allow employees to utilize their seven days of special leave for family events.
  • Negotiate individual contracts or frame flexible leave policies for adoption purposes.

Earned Leave in Cambodia

The official leave policy in Cambodia has laid out comprehensive guidelines to offer paid annual leave to those with more than one year of continuous service:

  • The minimum entitlement for annual earned leave in Cambodia is 18 days.
  • You may accrue paid annual leave at 1.5 days per month of continuous service, increasing with seniority at an additional rest day for every three years of service.
  • Khmer New Year is the customary time for annual leave. Moreover, you may split leave of over 15 days (except for employees under 18 and apprentices) and offer the remaining entitlement at another time of the year.
  • Public holidays, sick days, maternity leave, and special family leave are not included in annual leave. However, any other leave for personal reasons counts towards annual leave calculations.

Further, you must extend weekly time off for at least 24 consecutive hours. Additionally, you may learn about compensatory leave as part of earned leave in Cambodia and fairly incentivize employees for additional work beyond regular hours.

Maternity Leave in Cambodia

The labor law mandates paid maternity leave in Cambodia for new mothers with the following provisions:

Provision Details
Leave duration 90 days (three months)
Additional relaxations at the workplace Entitled to lighter duties for two months upon return
Maternity pay 50% of regular wages and benefits, paid by the employer
Minimum service requirement One year of continuous service
Job security Cannot terminate employment or lay off during leave

Here’s a quick reference guide to maternity leave in other countries to get inspired and offer a more generous leave policy in Cambodia.

Parental Leave in Cambodia

Unlike maternity leave, the official leave policy currently doesn't have specific provisions for parental leave in the traditional sense.

You can look at best practices worldwide and frame your leave policy to extend parental leave in Cambodia.

Paternity Leave in Cambodia

There is no mention of granting leave to eligible fathers right after their childbirth. However, you may allow employees to utilize a special seven-day paid family leave provision to extend paternity leave in Cambodia.

Public Holidays in Cambodia

  • Each year, the Ministry in Charge of Labor issues a Prakas (ministerial order) determining public holidays in Cambodia:
    • New Year's Day (January 1)
    • Victory Day over Genocide (January 7)
    • International Women's Day (March 8)
    • Khmer New Year (April 13-16)
    • International Labor Day (May 1)
    • King Norodom Sihamoni's Birthday (May 14)
    • Visak Bochea Day (Varies - Buddhist holiday)
    • Royal Ploughing Ceremony (Varies - Traditional ceremony)
    • Queen Norodom Monineath Sihanouk's Birthday (June 18)
    • Constitution Day (September 24)
    • Pchum Ben Day (Oct 1-3)
    • Mourning Day of the Late King-Father NORODOM SIHANOUK of Cambodia (15 October)
    • Coronation Day of His Majesty Preah Bat Samdech Preah Boromneath NORODOM SIHAMONI, King of Cambodia (29 October)
    • National Independence Day (09 November)
    • Water Festival (November 14-16)

The leave policy in Cambodia requires the following day of a public holiday that falls on a weekend to be paid time off.

Sick Leave Policy in Cambodia

The sick leave policy in Cambodia addresses long-term hospitalization leave with varying pay regulations depending on the duration:

Provision Details
Leave duration Up to six months
Job security Cannot terminate employment during the period
Pay benefits
  • 1st month: 100% of wages
  • 2nd & 3rd months: 60% of wages
  • 4th to 6th months: No pay

Casual Leave In Cambodia

You may grant casual leave in Cambodia if the employee has unused annual leave. Additionally, you may extend special leave provisions lasting up to seven days for every immediate family event, including bereavement leave.

Unpaid Leave In Cambodia

The official labor law doesn’t explicitly prescribe unpaid leave; however, you could frame your leave policy in Cambodia as offering standard sabbatical leave, among other leaves.
